Government may require the private party to reinstate or repair the facility on the basis of different specifications. Any such request will be treated as a government-initiated Modification (but only to the extent that the specifications differ from those which would otherwise have been required under the project agreement and to the extent that any insurance proceeds do not cover the full reinstatement cost).91
