Principle Government may step-in and assume all or some or the service delivery obligations of the private party when: (a) there is an emergency, a serious risk to the structure of the facility or the works, the environment, the public or users of the facility, or a serious risk of material damage to public or private property; (b) step-in is necessary to discharge a statutory duty; or (c) an Event of Default remains unremedied or a Default Termination Event or Force Majeure Termination Event occurs. |
