SAFETEA-LU continued this TEA-21 program by authorizing tolling on up to three existing IHS facilities to finance needed reconstruction or rehabilitation of IHS corridors that could not otherwise be adequately maintained or improved. Each of the three facilities must be in a different state and only one slot currently remains open.77 The key limiting factor of this pilot program is that toll revenues must be used only for re-investment in the facility being tolled, operations and maintenance costs, debt service, or to provide a reasonable return for a private investor.
