The Contract should include a specific termination trigger relating to the Contractor landfilling more than the Target Landfill Tonnage. The trigger shall only apply when a failure has occurred and Authorities should not seek the right to terminate in anticipation of a failure. Drafting in relation to such termination triggers will be set out in the model Contract.
