The Contract should include a specific termination trigger for non acceptance of Contract Waste. The trigger should be appropriately calibrated to reflect the severity of the failure13 and to allow the Contractor sufficient time to remedy the cause of the non acceptance.

13 The Authority may decide that it is appropriate to include a termination trigger to address scenarios where an Authority's waste is treated at an alternative facility. This may be relevant where an Authority's facility includes other benefits (such as environmental benefits through CHP), in addition to diversion of MSW.
