The Local Authority Act 1992 is the governing law in Namibia relating to local government affairs. The Local Authority Act has been amended in 2000 when the MRLGH made regulations relating to the entering into joint business ventures by local authorities and to the commercialization of services functions or duties.
The 'Guiding Principles and Policy Guidelines for Public-Private Partnership Projects' by the MRLGH is intended to form the foundation for enactment of a future national policy on local level PPP, which does not currently exist. In Namibia there is the need for an overarching national policy to guide decision makers on PPP arrangements. However, the national policy framework should be informed by the experiences of the pilot local authorities, as the implementation phase is crucial to understand what the needs and priorities are in relation to PPPs.
