Policy and Legal Framework

This project is a good example of the benefits of undertaking a PPP initiative within the specific context of national policy and legislation. In this case, the project benefited by having significant attention and support from the national environmental agency responsible for the legislation. Moreover, the legislation gave a clear mandate to the local government to be involved in the issues of a MRF. This should be contrasted to situations where the local government might not have such a mandate and may want direction from central government before proceeding with a PPP.

The project also has a good feedback into national policy. Indeed, the project was strongly sponsored by the national environmental agency to provide an incubator for further developing and refining the actual implementation of the environmental law governing MRFs. This substantially increases the potential for replication. Already the lessons from the project in Calamba have been communicated to other local areas in the country, and a guideline document has been produced.

In establishing the MRF company, substantial attention had to be paid to relevant legal framework for such a company to be established, and with the participation of a local government. The provisions of numerous laws had to be taken into account. This highlights that often PPPs can face a relatively complex series of legal issues, often raised in a wide range of different laws and regulations.
