The Programme would have benefited from the development and dissemination of operational guidelines for PPP arrangements and from the review of tender regulations for the promotion of PPPs. The incorporation of operational guidelines for PPPs in the Local Government Act (1997) would have also strengthened the policy and legal framework.
The Ministry of Local Government was in the process of revising some of the provisions in the tender regulations in line with the lessons learned from the pilot projects. This did not take place since the Ministry was not facilitated to monitor and supervise the projects and to learn from them.
However, as part of the Programme activities relevant existing policies and legislation were reviewed and sections requiring streamlining to support innovative PPP approaches were identified.
Some municipalities drafted bye-laws to create an enabling environment for PPPs.
