Agencies must include the results of the public interest test in the general format outlined in this Annexure, together with an on-balance assessment of the test results, with documentation seeking project approval. Government will take account of the test when considering an application for project funding
It is important that government has sufficient evidence of protection of the public interest before approving funding and allowing significant resources to be committed to project development. The test must identify any deficiencies, the means planned to address these deficiencies and any alternative options.
There is an ongoing requirement throughout the procurement process at key stages of government approval (EOI, RFP, contract execution) to identify any changes to the public interest assessment and/or confirm that the project remains in the public interest.
The RFP should include a clear description of the public interest issues and the manner in which any areas of potential concern have been taken into account in the proposed contractual or regulatory framework. Bidders should be given clear direction in relation to any hurdles or absolute constraints resulting from measures taken to protect the public interest.
The project summary published following the completion of the procurement process is to include a summary of the public interest considerations. Further detail on the project summary is available in Annexure 8.
