4.2.1  Non-conforming bids

The government should spell out in the request for expression of interest document and the project brief the approach it intends to take in evaluating non-conforming bids. When the government evaluates bids, it must be consistent and equitable in applying the criteria. Bids which do not conform with the requirements in the request for binding bid document cannot be compared on a like-for-like basis with bids which meet those requirements. The request for binding bid document could require that all proponents should submit fully conforming bids to provide a basis for comparative evaluation. Non-conforming bids could be submitted as optional extras.
