4.3  Dealing with probity issues

It is likely that unanticipated probity issues will arise throughout the competitive bid process. In these circumstances, members of the government project team should draw the matter to the attention of the project director as soon as possible for advice and resolution. The staff involved should document the issue, record who was consulted and how it was resolved.

There is potential for breaches to occur notwithstanding the best endeavours to maintain a robust competitive bid process. When serious breaches occur or it is identified that there is potential for a serious breach to occur, the government project team should obtain advice from the probity auditor on the best way to address the breach or potential breach. In general, all communications between the government project team and the relevant proponent should cease until all options have been assessed.
