The design and construction contractor will be appointed by the private party to carry out or manage the design and construction of the project assets. The contractor will also typically assume the associated long-term maintenance obligations. Some consortia will elect to appoint a different contractor for the long-term maintenance, but this can lead to tensions within the consortium where design, construction and maintenance liabilities overlap. The contractor will commonly be a member of the private party consortium.
