Potential or actual conflicts of interest is an issue that can arise in many contractual situations. As a result, a conflict of interest clause will be included in the contract. In many cases it may be necessary to obtain a separate deed, or undertake investigations to ensure that the contractor (including its employees, subcontractors or agents) is not in a position where their business, or personal interests, could conflict with those of the acquiring entity or other parties assisting the acquiring entity.
