8.1 The Joint Waste Partnership is constituted as an Advisory Executive Joint Committee (hereinafter called the "Joint Waste Partnership").
8.1.1 "Advisory" - it has no decision making powers delegated to it, but may advise and recommend to the constituent authorities.
8.1.2 "Executive" - it covers only executive functions of the constituent authorities, not non-executive functions. As a matter of law, this means that under the Discharge of Functions Regulations it is appointed by the Executives of each constituent authority, must comprise of only members of the Executives of each authority, and is subject to the executive access to information provisions in the Access to Information Regulations 2000, as amended.
8.1.3 "Joint" - it comprises more than one authority.
8.1.4 "Committee" - it is a body established by the constituent authorities in accordance with the provisions contained in Section 102 of the Local Government Act 1972 for the establishment of Committees.
8.2 In particular:
8.2.1 The Joint Waste Partnership shall be constituted to advise each of the Partners on the discharge of its executive functions in respect of waste collection and / or waste disposal.
8.2.2 Accordingly, the Members to be appointed to it shall be members of the Executive of each Partner, appointed by the Executive of each Partner.
