8.52 In these cases, the contract should be drafted to provide for sufficient flexibility of arrangements on completion of the primary period. For example, it could include an option for the private sector to purchase the land for at least OMV if the NHSScotland body no longer wishes to use the facility. In the event of early termination or expiry of the contract (including the expiry of the primary concession period), the headlease to the Project Company should automatically fall away.
8.53 Any decision that an NHSScotland body takes with regard to the property at the end of the primary period should be made after consideration of the NHSScotland body's overall estate holdings. A sale should never prejudice the best interests of the NHSScotland body's overall estate holding.
