The higher of

a)  the tonnage of Contract Waste Accepted; and

b)  the Minimum Tonnage of Contract Waste falling within Base Price Band 'n' in the relevant Contract Year except where the Contractor has failed to comply with Clause [refer to Clause dealing with substitution of Contract Waste] the Minimum Tonnage referred to shall be reduced by the tonnage of waste the Contractor would have secured if it had complied with its obligations under Clause [refer to Clause dealing with substitution of Contract Waste]
