27.8 Sub-hubco shall procure that:
27.8.1 there shall at all times be a sufficient number of staff (including all relevant grades of supervisory staff) engaged in the provision of the Services with the requisite level of skill and experience. To avoid doubt, this obligation shall include ensuring that there are sufficient staff to cover periods of holiday, sickness, other absence, and anticipated and actual peaks in demand for each of the Services; and
27.8.2 all staff receive such training and supervision as is necessary to ensure the proper performance of this Agreement and compliance with all health and safety rules, procedures and requirements[;
provided that Sub-hubco shall not be in breach of its obligations under this Clause 27.8 to the extent that such breach is caused or contributed to by the Authority failing to comply with its obligations under Clause 27.9.
27.9 [The Authority agrees to permit and arrange for any person who in the event that he or she remains in the employment of the Authority as at the Relevant Service Transfer Date will be a Transferring Authority Employee to receive training and to make familiarisation visits to the Facilities (all as reasonably requested by Sub-hubco and in such manner as to ensure that there is no material adverse effect on the operations of the Authority as a result of the same.]
