The 2006 Order removes Crown immunity in the planning process. The removal of Crown immunity means that the Crown is now in a position to make an application for statutory planning permission (whether or not the owner of the land) which could be implemented by a private operator.
Article 118 of the 1991 Order defines Crown Land as meaning land on which there is a Crown Estate.
