19.7.3  Environmental Impact Assessment

Article 67 of the 1993 Order (as introduced by the Roads (Environmental Impact Assessment) Regulations (Northern Ireland) 1999) makes provision for a special procedure to apply where the area for the construction or improvement of a road exceeds 1 hectare or is in a sensitive area. Article 67 A makes provision for a determination as to whether or not such a project should be made subject to an EIA and if so, an Environmental Statement must be published and members of the public and relevant consultation bodies must be given an opportunity to comment before the ORO decides whether to proceed with the construction or improvement works. After considering any opinions which may have been expressed, ORO is required to cause a local inquiry to be held if it appears to ORO to be necessary to do so. Any interested person is permitted to appear at the inquiry. ORO then makes a decision as to whether or not to proceed with the construction or improvement.
