7  ALTERNATIVE FACILITY OR ASSET

7.1  In the event of any of the whole or a significant part of the [Asset] being Unavailable due to a Criminal Damage Event, the Contractor shall use all reasonable endeavours to mitigate disruption of the use of the [Asset] and shall submit to the Authority as soon as practicable and in any event within twenty (20) Business Days of the Criminal Damage Event fully costed proposals (the costs to be borne by the Authority) for provision of:

7.1.1  equivalent alternative facilities or asset(s); and

7.1.2  ancillary services to enable such alternative facilities or asset(s) to be used for the same purposes;

for the period commencing when the [Asset] (or part of the [Asset]) becomes Unavailable and ending on the date that is two (2) months after the [Asset] is repaired, reinstated or replaced in accordance with this Schedule [*] (Criminal Damage).

7.2  The Authority may (in its absolute discretion) accept the costed proposals submitted by the Contractor or any amended costs proposals that Contractor submits at the request of the Authority.

7.3  Alternatively the Authority, at its cost shall (in a manner which does not impede the Criminal Damage Reinstatement Works) be entitled to:

7.3.1  provide alternative facilities or asset(s) whether on the site of the [Asset] or elsewhere;

7.3.2  make any necessary connections with drains, pipes, cables or other service media within the site of the [Asset]; and

7.3.3  provide such ancillary services as may be required to enable the [Asset] to be used by the Authority.
