35.1A [The Board shall pay the Interim Service Payments due from it pursuant to the terms of Part 16 of the Schedule (Interim Service Requirements) in accordance with the transitional arrangements and in accordance with the invoicing and payment provisions set out in that Schedule.]
35.1 Project Co shall not be entitled to receive any Service Payments until the Payment Commencement Date. Subject to the provisions of this Agreement, the Board shall pay Project Co the Service Payments in respect of each Contract Month following the Payment Commencement Date in accordance with the provisions of Part 18 of the Schedule (Payment Mechanism).113

113 Practical completion of the Works triggers commencement of payment of the unitary charge. The payment mechanism should be structured so that payment of a relevant percentage of the unitary charge commences on Practical Completion; with build up of the payment being linked to completion of each phase of Post Completion service commissioning (so that an increase in payments is triggered by completion of each phase until full payment is reached). The basic principle is that Boards only pay for what they, in fact, receive.
