46A.1 If Project Co breaches Clause 7A (NPD Requirements and Payment of Surpluses) then the Board may terminate this Agreement at any time within 18 months of becoming aware of such breach in accordance with Clause 46A.2 below. Where the Board becomes aware of such breach, it shall inform Project Co of the occurrence of such breach as soon as reasonably practicable thereafter, provided that the failure by the Board so to inform Project Co shall not constitute a breach of this Agreement by the Board.
