16.6 The indemnities under this Agreement shall not apply and there shall be no right to claim damages for breach of this Agreement, in delict or on any other basis whatsoever to the extent that any loss claimed by either party is for Indirect Losses suffered or allegedly suffered by any party.
16.7 Subject to the provisions relating to Participants' negligence in Clauses 16.1 and 16.2 no Participant shall be liable in delict to hubco or any hubco Party in respect of any negligent act or omission of the Participants or any Participant Party relating to or in connection with this Agreement and hubco shall procure that no hubco Party shall bring such a claim against the Participants. hubco has accepted this on the basis that it and each hubco Party will cover the risk of negligent acts or omissions by insurance or in such other manner as it (or they) may think fit.
