Notwithstanding any other provisions of this Agreement, no Party shall be entitled to recover or make a claim under this Agreement in respect of any loss or damage that it has incurred to the extent that such Party or, in the case of hubco, a Project Service Provider, has previously recovered in respect of such loss pursuant to this Agreement or otherwise.
