2.14  hubco shall procure that there shall be provided for each NHS Participant Employee, as far as practicable on termination of employment on or after the Transfer Date, rights which replicate those to which the NHS Participant Employee would have been entitled under the NHS Pension Scheme Regulations and the NHS Compensation Regulations had he remained in NHS employment. If any such employee is not provided such rights under the Broadly Comparable Scheme then he shall be provided with compensation which is of equivalent value to such rights.

2.15  Where hubco (or a relevant Partnering Subcontractor) is an Admission Body, hubco shall (and/or shall procure that any relevant Partnering Subcontractor shall) award benefits (where permitted) to the LGPS Participant Employees under the LGPS (Compensation) Regulations and/ or the LGPS in circumstances where the LGPS Participant Employees would have received such benefits had they still been employed by the relevant Local Authority Participant.

2.16  Where the award of benefits in paragraph 2.15 is not permitted under the LGPS (Compensation) Regulations and/or the LGPS or where hubco (and/or a relevant Partnering Subcontractor) is not an Admission Body, hubco shall (and/or shall procure that any relevant Partnering Subcontractor shall) award benefits to the LGPS Participant Employees which are identical to the benefits the LGPS Participant Employees would have received under the LGPS (Compensation) Regulations and/or the LGPS in circumstances where the LGPS Participant Employees would have received such benefits had they still been employed by the relevant Local Authority Participant.

2.17  Where under paragraphs 2.14 and 2.15 such benefits are of a discretionary nature, they shall be awarded on the basis of the relevant Local Authority Participant's written policy in relation to such benefits at the time of the Transfer Date (which the relevant Local Authority Participant shall provide upon request). Where the payment of such benefits is not, for whatever reason, possible, hubco shall (and/or shall procure that any relevant Supply Chain Member  providing any of the Partnering Services shall) compensate the LGPS Participant Employees in a manner which is broadly comparable or equivalent in cash terms.32
