2.  DETERMINATION OF TRANSFER PAYMENT

2.1  In respect of its own NHS Participant Employees, each NHS Participant shall request that the SPPA shall invite each NHS Participant Employee who joins the Broadly Comparable Scheme to elect to a transfer from the NHS Pension Scheme to the Broadly Comparable Scheme in respect of their pensionable service accrued in (or credited in) the NHS Pension Scheme before the Transfer Date.

2.2  It is acknowledged that any NHS Participant Employee wishing to elect to such a transfer of their rights will need to notify the SPPA of their election in writing within such period as the SPPA shall specify in its invitation (usually no later than three (3) months after the date of the invitation).  Once the relevant NHS Participant has been notified that SPPA has supplied the necessary data to GAD, that NHS Participant shall then instruct GAD to calculate the Pension Liabilities in respect of such NHS Participants and to supply the Employer's Actuary with its calculations of said Pension Liabilities. The Employer's Actuary shall have twenty-one (21) days to verify those calculations.

2.3  Each NHS Participant (in relation to itself and the NHS Pension Scheme, in either case, in respect of its own NHS Participant Employees) and the Employer (in relation to itself and the Broadly Comparable Scheme) shall use their respective reasonable endeavours to procure that all such information as the SPPA and/or GAD may reasonably require for the purposes of this Schedule Part 16 (NHS Bulk Transfer Terms) shall be supplied promptly and such information will be fairly presented, accurate and complete in all material respects.
