In so far as AVCs have not been applied within the NHS Pension Scheme to purchase added years of service, any benefits attributable to the AVC Fund shall be disregarded for the purpose of calculating the Transfer Payment. In respect of its own NHS Participant Employees, each NHS Participant shall nevertheless request that (subject to the payment of the Transfer Payment being made, and to the Employer having complied in all material respects with its obligations under this Schedule) on or before the Pension Payment Date, the SPPA pays, transfers or procures the payment or transfer to the Broadly Comparable Scheme of the amount attributable to the AVC Fund. Where that happens, hubco shall procure that the Employer shall procure that the Broadly Comparable Scheme will apply that amount in the provision of additional benefits under the Broadly Comparable Scheme on a money purchase basis for and in respect of the Transferring Members who had so contributed.
