The Contract assumes that the Scottish Ministers, (not the Board) own the site on which the building will be situated (the "Site").
The Contractor normally obtains a right of access to the land by way of a licence being granted by the Scottish Ministers allowing the Contractor to access the land for the purposes of constructing the buildings and providing the services. The Contract contains a draft Licence Agreement which will be entered into by the Scottish Ministers and the Contractor, and the Board is obliged to procure that the Scottish Ministers enter into this Licence Agreement (although often in practice the Scottish Ministers tend to authorise an individual from the Board to enter into this Licence Agreement on their behalf).
The land the Facilities are on remain the property of the Scottish Ministers at all times (Clause 14 and Schedule Part 7).
