The Contract is what is known as an "output specification" contract. This means that it is the Contractor's responsibility to ensure that it produces, designs and ultimately provides Facilities which meet the Board's requirements as set out in the tender documentation and subsequently contained in the Contract ("Board's Construction Requirements") (although please see the comments on clinical functionality at paragraph 3.3).
