The core of the Contract is the provision of services which the Contractor must provide during what is called, the Operational Term (the period of 25 or 30 years from the Actual Completion Date to the end of the Contract).
The services will take the form of monitoring and maintaining the fabric of the Facilities, possible cleaning of the Facilities and/or perhaps the provision of catering.
The basic premise of a PPP Contract is that if the Contractor is not providing the required service, the Board does not pay for it. This is managed in practice through the operation of the deduction regime in the payment mechanism (see paragraph 11). Continual under-performance by the Contractor may even result in termination (Clause 44) (see paragraph 24).
