If the Contractor is not meeting Service Level Specifications, there are two main consequences:-
10.2.1 Deductions may be made from the Monthly Service Payment due from the Board to the Contractor (see paragraph 11- Payment Mechanism); and
10.2.2 Deficiency points known as Service Failure Points are incurred. If more than a specified number of Service Failure Points are incurred, (or the Contractor commits a serious breach of its obligations), then the Board may issue a "Warning Notice" which may ultimately lead to termination of the Contract. (See paragraph 12 (Warning Notices)).
