Where an area is declared Unavailable, the Contractor can offer the Board temporary alternative accommodation that is appropriate, meets the Availability Conditions and is readily available, at no additional cost to the Board. The Board can refuse to accept this, acting reasonably. Where the Board accepts the accommodation and the Contractor does not restore availability by an agreed return date, the Board can deduct 50% of the Service Payment for the temporary alternative accommodation.
