Employees working for the Board may transfer to the Contractor upon completion of the Facility to become engaged on the provision of the Services as employees of the Contractor. For example, a cleaner in the Board's existing hospital may transfer to become a Contractor employee when new Facility opens. The Contract contains obligations on both parties in respect of the terms and conditions of such employees, their pension entitlement and each party's liability for breach of regulations known as The Transfer of Undertakings (Protection of Employment Regulations, or "TUPE".
