22.  Financial Consequences of Different Types of Delay Events

As noted in paragraph 21 above, if a Delay Event occurs, the Contractor gets an extension to the Completion Date but does not get an extension to the Contract. This means that although it will not necessarily get all the money which it was anticipating, it will not get terminated for failure to complete the Facilities on time. This is sometimes referred to as "Time" relief. In some cases it is also appropriate that the Contractor gets compensated for the money it has lost as a result of the delay - for example where the delay is the Board's fault. Where the Contractor is also entitled to financial compensation, this is often referred to as "Time and Money".
