2.1 The Contract contains a number of provisions which are derived from the requirements of the Scottish Government's Protocol and Guidance on Employment Issues in PPP Contracts. Firstly, any employees engaged in the provision of the services must be engaged on no less favourable terms and conditions when compared with those who have transferred from the Board. The Contractor is obliged to consult with employees' unions when setting these new employees' terms and conditions.
2.2 The Contractor must provide information to the Board, throughout the life of the project, which will enable the Board to investigate whether or not the Contractor is satisfying the requirements of the staffing protocol, including maintaining the terms and conditions of employees etc.
