3.1 On expiry or termination of the Contract, TUPE should apply to any transfers of staff from the relevant service provider/Contractor back to the Board or a new service provider/Contractor. The outgoing Contractor or service provider is responsible for any employee related claims arising prior to the termination date/expiry date.
