Concern was also raised regarding restrictions on pre-award negotiations, which may reduce the ability to obtain the best deal for taxpayers. For example, the SH 130 Project in Austin, Texas realized significant savings due to pre-award negotiations to incorporate the unsuccessful proposers' concepts into the final contract. Other planned Texas DOT projects will not be able to benefit from the same process without special approval. Texas DOT provided a synopsis of current law and offered suggested changes, which are discussed in the following sections.[361]
