64 It is anticipated that, in the majority of cases, a Board will wish to consider using a benchmarking process rather than market testing as their first option. Accordiangly, the market testing provision found within the Department of Health's standard form project agreement has been removed from this agreement and is currently being reviewed by the Scottish Government. Appropriate contractual provisions should be developed on a project specific basis.
