3.1 Subject to paragraphs 2 and 3.2 of this Part 26 of the Schedule, all Disputes shall first be referred to the Liaison Committee for resolution and any decision of the Liaison Committee shall be final and binding unless the parties otherwise agree in writing.
3.2 Where a Dispute raises issues which are related to the matters set out in paragraphs 7.1.1 or 7.1.2 and the Contractor or Service Provider (as the case may be) has notified Project Co of its intention to refer the relevant Construction Contract Dispute or Service Contract Dispute (as the case may be) to adjudication then reference of such Dispute to the Liaison Committee shall not be a precondition to the commencement of Adjudication or Arbitration.
3.3 For the avoidance of doubt, where the circumstances in paragraph 3.2 arise but a Dispute has already been referred to the Liaison Committee and a final and binding decision of the Liaison Committee has already been given, the decision of the Liaison Committee in relation to such Dispute remains final and binding.
