Subject to the provision of Clause 5.3 below, Y and Z Councils (acting severally) appoint, with effect from the Commencement Date, X Council to be the Lead Authority for the discharge of the Key Procurement Functions which functions shall be carried out for and on behalf of the Authorities and X Council agrees to act in that capacity subject to and in accordance with the terms and conditions of this Agreement.
