Legislatures are primarily responsible for deciding whether a state is to engage in PPPs and, if so, crafting a policy framework to define the objectives and rules of PPP implementation.96 Because enabling legislation guides a state's PPP program development and the selection and execution of specific projects, legislators can be directly or indirectly involved in all stages of the PPP process. In some states, legislative approval is also required for specific projects.
