6.6 A Joint Waste Authority will have the ability to enter into contracts with third parties and will do so in the same way as individual local authorities currently do. This will include adhering to all applicable procurement legislation and the financial and contract procedure rules which the Joint Waste Authority will itself need to adopt.
6.7 This ability to enter contracts in its own name is one of the key distinctions between and benefits of a JWA as opposed to a Joint Committee arrangement and considerably simplifies the interface with third parties with whom the Joint Waste Authority is contracting. Where there are existing contracts (i.e. contracts entered into by constituent authorities before the establishment of the JWA) in relation to a function which is to be transferred to the Joint Waste Authority, it is intended that the parties to the contract should agree that the contract shall be assigned from the constituent authority to the Joint Waste Authority. If a contract which the constituent authorities wish to be transferred to the Joint Waste Authority cannot be assigned because the parties cannot agree to the assignment or for some other reason, the constituent authorities should advise the Secretary of State.
