6.17 The JWA may establish scrutiny arrangements such as an Audit, Performance and Scrutiny Committee (as suggested above). This will have terms of reference which set out how the members of the Committee will scrutinise the activities of the JWA itself.
6.18 Also, the Overview and Scrutiny Committees of all local authorities have broad powers to make reports on matters which affect their area. This means that under current legislation, each constituent authority would retain the power to review and scrutinise the work of a JWA in relation to their area. This is strengthened by the powers of Overview and Scrutiny Committees to request information from and send reports to 'partner authorities' who must have regard to such reports. JWAs will be partner authorities for the purposes of this legislation.19
