This section of the report contains a detailed over-view of the major legal requirements to the implementation of PPPs in the U.S. highway sector. Each of the following subsections describes a particular type of legal impediment, discusses the specific ramifications of such impediment to highway PPPs, and explores possible solutions to dealing with such impediment that have been used or considered in other projects. The first two subsections below, dealing with federal law requirements and state law requirements, also contain a de-tailed discussion of recent legislative changes that have been made to facilitate the implementation of PPPs.
