Though there is an option that would allow the public to legally transfer full operating rights to the private sector for a defined period (known as "Build-Own-Operate" and used overseas), no one in Texas is giving serious consideration to this financing approach.
Rather, all types of PPPs contemplated in Texas merely grant the private party contractual rights in return for contractual obligations. The state at all times retains full legal ownership of the project.
