8.1 The Parties shall act at all times in a way that promotes effective partnership working. In particular, each Party will:
8.1.1 work in good faith with the other Parties towards the mutual advantage of the Parties;
8.1.2 adopt an approach to identifying and resolving problems together rather than taking an adversarial stance;
8.1.3 act reasonably and achieve, as minimum, their Statutory Targets and those contained in the WS2007;
8.1.4 provide relevant information to the other Parties in a form that is readily usable and in a full and timely manner. Relevant information shall include, without restriction or limitation:
(a) details of contractual arrangements (or amendments to existing arrangements) entered into by the Parties in their roles as WCAs or WDA;
(b) early warning of potential failure by a Party or its contractor in meeting their obligations under this Agreement;
(c) details of actual failure by a Party or its contractor in meeting their obligations under this Agreement;
(d) new initiatives, policies or emerging policies relating to the minimisation, collection, recycling and disposal of Waste;
(e) any other information that could reasonably be expected to impact upon this Agreement or the Parties to this Agreement; and
(f) details of any external funding opportunities which are available (and where appropriate, the Parties shall work together to submit joint bids for such funding);
8.1.5 take all reasonable steps to mitigate any losses arising from a Party's failure under this Agreement;
8.1.6 work together with the other Parties to achieve the Statutory Targets and as far as is reasonable or practicable, to reduce the detrimental impact on the Parties and council tax payers of any one of them failing to carry out its obligations under this Agreement;
8.1.7 any requirement on a Party under this Agreement to act reasonably shall be interpreted in the context of the Parties endeavouring to achieve the Mutual Aims while minimising any detrimental impact on the public purse;
8.1.8 use all reasonable endeavours, working with the other Parties as appropriate and in conjunction with the PFI Contractor, to minimise Waste and to improve the amount of Waste that is recovered and recycled in line with Government targets, new Legislation and in particular Landfill Directive 1999/31/EC, to educate the public and the commercial sector about recycling schemes, and why their participation in these schemes is crucial, and to ensure that as much Municipal Waste as possible is (in order of priority) reduced, re-used, recycled or recovered;
8.1.9 co-operate in identifying, as early as reasonably possible, any issues or problems which will or may tend to prevent the achievement of the Mutual Aims and to reach and implement solutions to overcome such issues or problems;
8.1.10 work with the other Parties to:
(a) influence behavioural change and to give people the knowledge and resources to take action at school, at work and in the community through Waste related education or awareness issues under appropriate campaigns where possible;
(b) make the strategic planning and development of Waste services as transparent as possible to each other and to the public as a whole;
(c) research, develop and implement detailed proposals to achieve the purposes referred to in Clause 8.1.10 (a) and (b) above;
(d) develop, implement, support and continue to enhance such schemes as are decided upon and in particular, to develop a Municipal Waste Management Strategy for [ ];
(e) enhance economic development and employment opportunities as part of these proposals wherever possible whilst embracing the principles of sustainability; and
(f) explore other appropriate partnership opportunities with both the private and public sectors in the pursuit of these aims and objectives;
8.1.11 take all reasonable steps to ensure that the planning, development and implementation of the Mutual Aims is transparent to all interested parties (including the public);
8.1.12 consult with all stakeholders having an interest in the Mutual Aims or wider waste services; and
8.1.13 work together, in a spirit of openness and mutual good faith, to resolve any difficulties openly, quickly and honestly, before any such issues has a negative impact on the operation of the Project Agreement.
