DOT Leadership Appointments and Requirements

The secretary of transportation and public works is appointed by the governor with the advice and consent of the Senate (PR. Const. art. IV, §5). The governor can remove any officer whom he or she may appoint, except those whose removal is otherwise provided for by the constitution (3 L.P.RA. §6). The two citizen members of the Advisory Board on Transportation are appointed to staggered four-year terms by the governor, within statutory requirements that they be "related to the transportation system in Puerto Rico," have satisfactory knowledge in the area of transportation and have an "excellent reputation in the Puerto Rican community." These members may be removed from office by the governor for negligence in the performance of duties, immoral conduct or other reasonable cause, after due notice and hearing. The other members of the board are the secretary of transportation and public works, the director of the Puerto Rico Office of Energy, the police superintendent, the chair of the Puerto Rico Public Service Commission and the chair of the Puerto Rico Planning Board (9 L.P.RA. §3153).
