15.7  No Change to the Design Proposals

For the avoidance of doubt the Contractor shall not amend or change the Design Proposals except either as a Contractor Change through Schedule 21 (Change Protocol) or pursuant to paragraph 3.3 of Schedule 26 (Planning).  Where the Contractor Change is necessary for the Contractor to comply with Clause 15.4 (Rectification of Construction Proposals), the Authority shall not be entitled to unreasonably withhold its consent to such a Contractor Change provided the implementation, rectification and consequential impact, is at the Contractor's expense.30

30  Authorities should set out the extent to which they expect designs to be developed by Bidders at call for Final Tenders to ensure Final Tender prices and Construction Sub-Contract proposals are robust before a Preferred Bidder is selected.  Further development of designs will need to be worked up during Preferred Bidder stage.
