18.1  Appointment

The Parties have on or prior to the date of this Contract in compliance with all Legislation relating to procurement which is applicable to either Party, appointed a suitably qualified and experienced consultant to act as the Independent Certifier for the purposes of this Contract upon the terms of the Independent Certifier's Deed of Appointment.32

32  It may not always be practical to appoint the Independent Certifier prior to contract signature.  If this is the case, the Authority should consider appropriate remedies if the Independent Certifier Appointment Deed is not entered into by the Contractor at the relevant time.
