33 Authorities should note that no provision has been made for the Authority to levy liquidated damages in the case of delay in satisfying relevant tests. However, Authorities to consider whether in any specific transaction such damages may be appropriate but should be aware that the Contractor will suffer financial detriment through any consequential delay in step up in payment and that the application of additional damages may not represent value for money since these may be priced in by the relevant Construction Sub-Contractor.
